Тогда, почему на него ругается Валидотор??? может его, тогда по другому надо написать (задать)???

Вы преувеличиваете значимость этих ошибок. Даже тег <h1> далеко не самое важное в оптимизации. Посещаемость в 3 раза после удаления ошибок у вас не вырастет))
